Use of terms of the Website and Hotel Service Agreement

Definitions

You -  Any visitor of the website or/and hotel guest;

Terms and Conditions -  Provisions defined by this document;

Privacy Policy - Provisions defined by the privacy policy on the website;

Third Parties -  Any person or/and company, except Gudauri Mountain Resort LLC and the visitors of the website;

Hotel Service Agreement -  The hotel service agreement signed between you and us in accordance with these provisions and Article 7 thereof;

Hotel Policy – The rules of behavior and staying in the hotel, which can be viewed on the Website. The material terms of the Policy will be printed out and handed to the Visitor of the Hotel

Reservation - An arrangement made with a hotel to have a room kept for you at a particular time in the future;

Check-in -  The process of registering upon arrival at a hotel;

Check-out - The process of leaving the hotel and settling your bill;

No-Show - A guest who makes a reservation but does not arrive or check-in;

Early Check-in - Checking in after the stipulated check-in time;

Late Check-out - Checking out after the stipulated check-out time;

Cancellation Policy -  The rules of cancelation of the booking specified in Article 7 hereto;

Occupancy - The number of people staying in a hotel or the use of the room(e.g., single or double occupancy);

Room Type -  Specifies the type of room (e.g., single, double, suite, deluxe, etc.);

Rate -  The cost of the room per night;

Rate Plan - Specific pricing structures or deals that may have special conditions (e.g., non-refundable, breakfast included, etc.);

Bed Type - Type of bed(s) in a room (e.g., king, queen, twin, etc.);

Amenity -  A desirable or useful feature/facility of a hotel room;

Deposit -  An amount paid as security and returned upon check-out unless there are damages or other costs;

Minimum Stay - the minimum number of nights the guest is obliged to reserve in order to be able to use the hotel room;

Maximum Stay - the maximum number of nights the guest is obliged to book in order to be able to use the hotel room;

Additional services - services or their part that may be provided by us or by another third party contractor;

Promo Code - A limited time or permanent discount code, after entering it in a special column on the website, you will receive a discount on hotel services and/or additional services;

Infant - Hotel guest aged 0-4 years;

Child - Hotel guest aged 5-12 years;

Penalty - monetary and/or other type of sanctions provided for violation of the provisions of the bylaw of the hotel.

  1. Consent to the rules and their changes

    1. These rules and privacy policy regulate the terms of use of our website - www.gudauriski.ge; By agreeing to these rules when registering on the website, we consider that you have read and accepted them and confirm that the latter do not contain ambiguous provisions.

    2. You access, use and operate our website at your own risk;

    3. The Company reserves the right, at its sole discretion, to modify these Terms and Conditions without prior notice.

    4. With each new session you initiate on the website, you agree to the modified terms and conditions, if any.

  2. Intellectual property

    1. The contents of the website, including but not limited to texts, figures, logos, diagrams, photographs, videos, audio, music, layout, design, know-how, technologies, products and processes are the property of Gudauri Mountain Resort or its related companies, is owned and protected by copyright and related rights, trademarks, patents and all other intellectual property rights that exist under applicable law.

    2. Except as provided in Section 3 of these Terms and Conditions, no part of the Website's content shall be construed as giving you the right to use it.

  3. Use of publicly available information

    1. The personal property and non-property rights of the website and its content belong to Gudauri Mountain Resort.

    2. You may download, publish or print the content of our website only for personal, non-commercial purposes and by preserving and reproducing the copyright and/or other proprietary rights notice on it.

    3. Any other use, including reproduction, modification, distribution, transmission or broadcast of the content of the website, in whole or in part and by any means, is strictly prohibited, except with the prior written consent of Gudauri Mountain Resort.

    4. The company is not responsible for the damage that may be caused to third parties by your use of the content of the website.

    5. You are authorized to download, display or print the contents of the Company's website for personal, non-commercial purposes only, thereby protecting the Company's intellectual property. Any other type of use, including full and/or partial reproduction, modification, transmission, distribution and similar actions of the content of the website is not allowed without the prior written consent of the company.

    6. The Company does not warrant or represent that your use of any content on the Website will not infringe the rights of third parties.

  4. Liability and scope of the company

    1. The Company does not warrant that the website or its content will meet your expectations, will be uninterrupted, timely, secure or error-free.

    2. Even in case of loss caused by restriction of access to the website or inability to use it, you agree that Gudauri Mountain Resort and/or the companies that ensure proper operation of the website will not be held liable.

    3. The company is free from any liability that may arise from downloading or receiving material from the website in any other form. The Company disclaims any responsibility for any damage or virus that may affect your computer equipment or other property due to your access, use or downloading of any material from the Website or any unlawful intrusion or interference with information technology systems.

    4. The Company reserves the right to limit or discontinue any or all functionality of its website. The company is released from any responsibility for the damage that may occur as a result of the limitation or termination of the mentioned functionalities by it or by third parties.

    5. The content of our website may contain inaccuracies or errors. The Company reserves the right, at its sole discretion, to make changes, corrections and/or improvements to this content at any time without prior notice.

    6. The hotel website may refer to products and services of third parties not affiliated with the hotel. In each such reference, the hotel may act as an intermediary and does not represent the owner of the mentioned products and/or the service provider. In any such reference to a third party, the Hotel will make a reference to indicate that the products and services are offered by third parties and the Hotel is not responsible for the quality and safety of mentioned products and services.

  5. Websites of the Third Parties

    1. The Website may redirect you to third-party websites to which these Terms and Conditions do not apply. The mentioned websites are regulated by the rules established by third parties. The company is not responsible for any kind of information, website content, terms and conditions placed on third party websites.

  6. Information not considered as Confidential

    1. Any personally identifiable data and information you may submit over the Internet to our website is protected and treated in accordance with our privacy policy. The Company encourages you to read the Privacy Policy carefully before providing personally identifiable information and/or other information.

    2. Any other information, except terms provided in the 6.1. article, which transfers to the Company via the Internet, e-mail or otherwise, including any data, graphics, ideas, questions, comments, suggestions, communications and etc, shall be treated as non-confidential. Anything you post and/or transmit to the Company is considered our property and may be freely used for any purpose.

  7. Special Conditions

    1. Using our website, you have the opportunity to enter into a Hotel Service Agreement with us remotely.

    2. Entering into the Hotel Service Agreement is done through the hotel room reservation page of the website. On the same webpage you will see all the links referring to the up to date terms and conditions.

    3. When making a reservation, you select the hotel name, the room type, the number of hotel rooms, occupancy and the number of nights in the hotel, as well as other information requested by the reservation system.

    4. At the time of booking, you may indicate the number of guests infants and children. The hotel reserves the right to determine the age groups for infants and children according to the Hotel Policy Rules and apply different pricing to such age groups.

    5. From our side, , the maximum occupancy, the room area and the room amenities will be specified for to each hotel and its specific room type.

    6. Before making a booking, you will have the opportunity to check the cancellation policy. The hotel is entitled to impose various cancellation conditions, including:

      1. cancellation of the reservation, after which the paid amount is not refunded;

      2. cancellation of the reservation, after which the refund is made in the percentage amount indicated on the website;

      3. Cancellation of the reservation, after which the paid amount is fully refunded.

    7. For specific periods, the hotel may set the minimum and maximum stay requirements, which will be indicated on the website.

    8. For a specific period, the hotel may establish a special rate plan, which may include a discount for certain duration and/or period bookings. Information about the special offer will be indicated on the booking page.

    9. The hotel reserves the right to require guests to pay a security deposit. If a security deposit is required, the guest is obliged to put the deposit at the time of check-in. If the guest does not violate the Hotel Policy, the deposit will be fully refunded to the guest. If the guest violates the Hotel Policy, the hotel has the right to withhold the penalty or damages imposed on the guest and return the remaining balance of the deposit to the guest.

    10. The Deposit requirement is a right of the Hotel which may be exercised by its sole discretion; However, such requirement may only be imposed if the Guest was duly notified in advance. If the Deposit requirement is imposed the Guest will be notified in advance concerning Deposit instructions and the Deposit amount.

    11. Standard hotel check-in time is 14:00-18:00.

    12. Standard check-out time from the hotel is 10:00-12:00.

    13. The guest has the right to request non-standard check-in and check-out times, which should be reported to the hotel at the time of booking. The hotel has the right to accept or refuse the guest to check-in and check-out at non-standard times. In the event that the hotel has agreed to non-standard check-in and check-out times, it is also authorized to charge the guest a special service fee for the mentioned service. The relevant fee amount and payment method will be notified to the guest in advance in writing.

    14. In case of no-show during the reservation period, as well as in the event that the guest does not make a request for late check-in service during the relevant reservation period, the hotel is entitled to register the no-show. In such a case, the hotel is entitled to claim the amount paid by the guest in full, and in the case of the guest's late arrival, require the guest to make a new reservation and pay the amount.

    15. The hotel has the right to impose a penalty on the guest for violating the Hotel Policy. The preconditions for imposing a penalty and the amounts of the penalty shall be indicated in the Hotel Policy and its material terms which are handed to the Guest after check-in.

    16. The hotel has the right to offer the guest additional services, which essentially may not represent the hotel services, but can create additional comfort for the guests. Such services can be provided both by the hotel itself and by other third parties. In the event that the specific additional service is rendered by another third party, who is responsible for the performance and quality of the such service, this will be indicated in the relevant information field.

    17. If the service is provided by a third party, the hotel acts as an intermediary (agent) in such a relationship and does not represent the person directly rendering the service. Accordingly, when rendering such services, the hotel does not take responsibility for the quality and conditions of the service, and the hotel is not responsible for the damages incurred in the case of non-performance or for the damages incurred in the case of damage to life and health.

    18. In the event that the service is provided by the hotel itself, the hotel acts on its own responsibility and is therefore responsible for both the quality of the service and only for the direct damage caused by the non-performance.

    19. In case of providing or offering additional services, the general content and cost of specific services will be specified in the offer.

  8. Dispute

    1. These terms and conditions are interpreted and governed by the legislation of Georgia.

    2. In case of any dispute and/or claim, you can contact the company by e-mail - info@gudauriski.ge; The company has the right to regulate and inform you of the relevant decision/answer related to your claim within 10 (ten) calendar days after receiving the notification; If the dispute cannot be resolved within the above-mentioned period, you have the right to apply to the court.

    3. Any dispute that may arise between you and us according to these terms and conditions or other related contractual relations will be resolved by mutual agreement, and in case of failure to reach such a dispute, the dispute will be resolved by the Tbilisi City Court;

  9. Miscellaneous

    1. It is forbidden to create any hyperlink on our website without the prior written consent of the company.

    2. If any provision or part of the Terms and Conditions becomes invalid, it will be superseded and replaced by the relevant version. Deletion or modification of any provision shall not affect the validity and enforceability of the General Terms and Conditions.

    3. These Terms and Conditions constitute the agreement between us and you regarding access to, use of, and content of the Website. Any other terms and conditions established by the Company governing its relationship with you, in particular regarding the purchase of any Services, are in addition to these Terms and Conditions; In the case of any inconsistency between them, the other terms and conditions shall prevail over these.

    4. The Company's failure to exercise its rights in response to your violation of these Terms and Conditions shall not be deemed a waiver of mentioned right by the Company.

    5. The headings and layout used in these Terms and Conditions are for convenience only and do not alter their content.
